Welcome to CertNow. These Terms of Service (“Terms”) govern your use of the CertNow mobile application and website (collectively, the “Service”) operated by CertNow Ltd (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Description of Service
CertNow provides a platform for UK landlords to:
- Store and manage property compliance certificates (Gas Safety, EICR, EPC, etc.)
- Receive automated expiry reminders for certificates
- Book Gas Safe registered engineers for property inspections and certifications
- Share certificates securely with tenants via generated links
2. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
3. Free Service & Commission Model
CertNow is free to use. There are no subscription fees or charges for storing certificates, managing properties, or receiving expiry reminders.
When you book an engineer through our platform, we receive a commission from the engineer or service provider. This commission does not affect the price you pay for the service.
4. Engineer Bookings
4.1 Third-Party Services
Engineers available through CertNow are independent third-party service providers, not employees or agents of CertNow. While we verify that gas engineers are Gas Safe registered, we do not guarantee the quality, safety, or legality of services provided by third parties.
4.2 Your Responsibilities
When booking an engineer, you are responsible for:
- Providing accurate property access information
- Ensuring someone is present at the property at the scheduled time
- Paying the engineer directly for services rendered
- Verifying the engineer’s Gas Safe registration before work begins
4.3 Cancellations
Cancellation policies are set by individual engineers. Please review the cancellation terms before confirming any booking.
5. Certificate Storage
You retain ownership of all certificates and documents you upload to CertNow. By uploading content, you grant us a limited license to store, display, and transmit your certificates as necessary to provide the Service.
We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You are responsible for maintaining backup copies of important documents.
6. Sharing Certificates
When you generate a share link for a certificate, that certificate becomes accessible to anyone with the link. Share links expire after 30 days by default. You are responsible for who you share links with.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload false, fraudulent, or misleading certificates
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems to access the Service without permission
8. Intellectual Property
The Service and its original content, features, and functionality are owned by CertNow Ltd and are protected by international copyright, trademark, and other intellectual property laws.
9. Disclaimer of Warranties
The Service is provided on an “AS IS” and “AS AVAILABLE” basis. CertNow makes no warranties, expressed or implied, regarding:
- The operation or availability of the Service
- The accuracy or completeness of any content
- The quality of services provided by third-party engineers
- That the Service will meet your requirements
10. Limitation of Liability
To the fullest extent permitted by law, CertNow Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, or business opportunities
- Property damage or personal injury resulting from third-party services
- Any issues arising from engineer bookings or certificate accuracy
Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim (which, given our free service model, may be zero).
11. Indemnification
You agree to indemnify and hold harmless CertNow Ltd and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may request export of your data before account closure.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.
